Terms of Service

1.) For all characters and logos submitted, a clear and concise image must be provided. Digital reference are preferred but I will take traditional references on a case by case basis. I retain the right to refuse a commission if the image submitted does not meet this criteria.2.) It is the clients responsibility to contact this business and have their commission approved before payment is sent. All approved commissions will be paid through an invoice sent through paypal. This business only accepts payment in USD. All other forms of payment must be exchanged for USD. It is the clients responsibility to ensure that they have sent the correct amount for their countries exchange rate.3.) For traditional work, the prices listed do not include shipping. It is in the clients best interest to calculate shipping costs when commissioning products, as this cost will be added to their invoice. shipping on small items is usually around $3.00. Shipping on larger items will be determined by weight and calculated once the commission is completed.4.) While we do our best to work in a timely manor, we do not work under deadlines. If you would like a commission completed by a certain date, be sure to commission the product well in advance. Popular times to order items are around the holiday season, so be sure to send us a message through our Facebook page in advance if you wish to receive your order in time. If you feel as though a deadline MUST be met, we may accept a rushed commission at an additional cost to the client, starting at $5.00 and being a max of $20.00 depending on how close the deadline is. If the deadline is unreasonable, we reserve the right to refuse the commission. We will always ship at least 3 days before the deadline, but the time for the delivery is not in our control.5.) We send pictures of your commission at the beginning of each stage of our process. This includes the initial sketch lining, flat coloring, and shading (if applicable). Once a stage has been approved by the client, that stage can no longer be altered. For example, if you approve the initial sketch and we move to lining, you may not request the pose to be altered. In the event that the pose, or other aspect of a commission must be changed after it has been approved, an additional fee may be applied to cover the expenses for time and/or materials already used. If it is past the point where an alteration is possible, the client has the option for a partial refund if they no longer wish to continue with the commission.6.) Eligibility for a refund will be left to our discretion and will be determined on a case by case basis. Once a product has been sent to the client, there will not be any refunds for any reason. We always give the client the opportunity to approve our work before its shipment. However, if the product arrives in a condition other than what was approved before shipment, please send a picture of your product through our Facebook page along with any concerns you may have regarding the quality or condition of your piece. This must be done within 24 hours of your item's delivery. If your item appears to have been damaged during its delivery, we will be willing to touch up any damages. Client pays shipping both ways if they wish to do this.7.) In the event that our que is full, you may request to be put on a waitlist. This is a courtesy service at no cost to the client and is provided for your convenience.8.) If you wish to request an alteration to the initial sketch of your commission, you may request a maximum of 3 small changes. Example: Expression or any missing details such as markings or accessories. Changing the pose, outfit or character is possible only in the initial sketch stage of your commission. Doing so is a fee of $20.00, as it required a drastic change to the already completed work, or re-starting the commission all together. You may do this a maximum of 3 times, each time having a separate additional fee.9.) Our style often fluctuates from piece to piece depending on how you describe your characters personality, and the references given. Bubbly childlike characters will often be seen drawn in a softer, more child-like style, and more serious characters will often be represented in a style that is more angular to better represent their character. However, if there is a specific style that you want your character drawn in, this must be disclosed to us in your commission's details. If left unmentioned, the style your character is drawn in will be left for the artist to decide. Changing the style would be considered a "major alteration", and a fee of $20.00 will apply to account for the work already completed. However, we will clean up the already completed sketch for you at no cost.10.) Critique and redlining is accepted only for commissions meeting or exceeding a value of $80.00. However if we do not think your alteration improves the quality of your product, we reserve the right to refuse the alteration. This especially applies to anatomy and style changes. As the artist, our style is our own. By commissioning us, you accept that our style often fluctuates, but the quality of our work will always done to our highest capability.11.) If the client wishes to cancel a commission before any work has been started, they are entitled to a full refund.12.) If a client wishes to cancel a commission after a sketch as been started at any stage, they are entitled to a 50% refund.13.) If a client wishes to cancel a commission at any point after the sketch has been made, they are entitled to a 25% refund.14.) Canceling a commission means that the client agrees that no further work will be put into their commission.15.) If the client wants to change their commission all together, they can do so at no cost if the sketch has not been started. If their new commission exceeds the value of the previous one, they can pay the difference. Alternatively, they will be refunded the amount of the difference in price if their new commission is lower in cost than the commission already paid.16.) The artist reserves the right to cancel a commission due to rude behavior, unacceptably poor communication or inability to communicate in english.17.) The artist reserves the right to decline commissions of people who have been previously blacklisted or have been otherwise known to be problematic. This involves known bewares regarding scamming other artists, back charging completed commissions and not giving credit.18.) The artist will contact you at the beginning of each stage of our process, however, if at any point you wish to see additional progress, we will do our best to get back to you with pictures and updates regarding your commission.19.) By commissioning this artist, you give them the right to use pictures of your commission as examples on their page or other media outlets. The artist has the right to use your commissioned piece to advertise for themselves on their own page or any other social media site.20.) We do not accept commissions displaying scenes of graphic violence/gore against real individuals. Fictional character gore is fine. Characters with extreme body types or a commission containing an extreme fetish may be subject to rejection or additional charge. This is taken on a case by case basis.21.) NSFW commissions have no extra cost unless they contain such graphic content that they can not be used by the artist as an example. Such content may include diaper fetishes, scat, watersports, vore, or any other subject matter that is not deemed appropriate or postable, even with heavy censoring.22.) The client may not profit from the work. This includes tracing, copying or heavily referencing our work. Prints for single personal use are acceptable, however mass production and redistribution for profit of our work of any kind is prohibited without our expressed permission. If you wish to sell our work as a print, contact us beforehand. We love supporting Con-artists! But not con artists. We may be able to negotiate the redistribution of our work for a royalty fee.23.) If you do not wish to have your work used as examples or released to the public for any reason, doing so will decrease foot traffic to our page, as well as make us lose opportunities for business. For this reason, we do ask that you pay a "no release fee" if you wish that your commission not be publicly shown for any reason. This fee will not apply however if your reason is to keep the commission a surprise as a gift. Let us know when we will be able to use your commission in our advertisements. If a month passes without communication in regards to your consent of release, we reserve the right to publicly post your commission.24.) The client may post the completed work or product to any social media site, but may only do so with proper credit. Using digital works as profile pictures is acceptable as long as it is captioned with either a link to this website or our Facebook page. Not crediting the artist is considered a violation of our terms and conditions and can result in a beware, or blacklisting from further commissions. This may affect your future ability to commission other artists.25.) If your commissioned piece is digital, the watermark/ artists signature may not be removed under any circumstance. We as the artist, agree to place our signature/ watermark in an area that is not distracting from the overall focus of the piece.26.) If you reject a sketch and wish to have another sketch made, we reserve the right to use the initial rejected sketch for a future commission, YCH, or personal work.27.) NSFW requires valid I.D. to confirm the clients age. Furthermore, any request of nsfw that involves illegal content such as minors, Necro, beastiality, or any other illicit content will not only be rejected, but will be brought to public eye to keep other artists and their businesses protected. We have a no tolerance policy on illicit nsfw content.28.) By commissioning this artist, you agree to the above terms and conditions. Any violation of these conditions will be met with appropriate action. By sending payment to the artist, whether by Paypal invoice or otherwise, you agree to these above conditions.
